Welcome to DroneImageBank, a database of drones-produced photos and videos (“Contributed Content” and the “Service” respectively). PLEASE READ CAREFULLY THE FOLLOWING LICENSE AGREEMENT, BECAUSE THE RIGHTS AND DUTIES UNDER THIS AGREEMENT, ALONG WITH THE DRONEIMAGEBANK TERMS OF USE AND PRIVACY POLICY, CONSTITUTE A BINDING AGREEMENT BETWEEN YOU, THE INDIVIDUAL OR THE ENTITY ACCESSING OR USING THE SERVICE ("YOU"), AND US AT DRONEIMAGEBANK.
Subject to the DroneImageBank Terms of Use [add link], the DroneImageBank Privacy Policy [add link] and upon the payment of license fees according to the pricing schedule as published at: www.DroneImageBank.com/____________[add link] (the “Terms”), DroneImageBank hereby grants you a non-exclusive, non-transferable, revocable right and license to use and reproduce the purchased Contributed Content worldwide for an unlimited amount of time and subject to the following limitations:
1. The license is granted to You only. You may not permit anyone else to use the Contributed Content. Notwithstanding the foregoing, in the event that you have purchased a license in the Contributed Content on behalf of your employer/client, either the employer/client or you may use the license, but not the both of you.
2. You must add the text "DroneImageBank" next to the Contributed Content when used in digital media and printed press.
3. You may not modify or make derivative works of any part of the Contributed Content.
4. Restricted Uses – You may not use the Contributed Content in any of the following manners:
4.1. In connection with any activity that will be deemed, or encourage activity that will be deemed threatening, harassing, anti-competitive, misleading, deceptive, libelous, defamatory, obscene, pornographic, profane or otherwise objectionable;
4.2. In connection with any activity that constitutes or encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, foreign law or industry standard, including, without limitation, any applicable laws and regulations governing privacy, defamation, mass email, spam, export control, consumer protection, unfair competition and false advertising;
4.3. In violation or breach this License Agreement, the DroneImageBank Terms of Use, the DroneImageBank Privacy Policy or any other applicable instructions or guidelines that we convey to you;
4.4. Allow others to use any rights in the Contributed Content in any way, including without limitations, by downloading, uploading, extracting, displaying, making available, modifying or redistributing the Contributed Content;
4.5. Falsely represent yourself or anyone else as the creator or the owner of the Contributed Content; or
4.6. Use the Contributed Content as part of a logo, trademark or service mark.
5. Notwithstanding any remedies that may be available to us under any applicable law, we may temporarily or permanently deny, limit, suspend, or terminate your license, prohibit you from accessing your account and take technical and legal measures to keep you off the Service, if we determine in our sole discretion that -
5.1. You have abused your rights under this License Agreement; or,
5.2. You have breached the DroneImageBank Terms of Service; or,
5.3. You have performed any act or omission which is harmful or likely to be harmful to us, or any other third party, including other users and providers of the Service.
